The Foldie Mobile Messaging Terms & Conditions

Last updated: September 7, 2026

The Foldie mobile message service (the “Service”) is operated by The Foldie, Inc. (“The Foldie,” “we,” “us,” or “our”). Your use of the Service constitutes your agreement to these Mobile Messaging Terms & Conditions (“Mobile Terms”).

We may modify, suspend, or discontinue the Service or any of its features at any time. To the extent permitted by applicable law, we may also update these Mobile Terms from time to time. Your continued participation in the Service after any updated Mobile Terms become effective constitutes your acceptance of those changes.

Consent to Receive Text Messages

By consenting to The Foldie’s SMS/text messaging service, you agree to receive recurring SMS and MMS messages from and on behalf of The Foldie at the mobile telephone number you provided, even if that number is registered on a state or federal Do Not Call list.

Messages may be sent using an automatic telephone dialing system or other automated technology.

Messages may include service-related communications, such as order updates, account notifications, customer-service information, and other transactional messages.

Promotional messages may include special offers, promotions, product launches, back-in-stock notifications, cart reminders, browse reminders, personalized product recommendations, and other marketing communications.

Your consent to receive marketing text messages is not a condition of purchasing any goods or services from The Foldie. Participation in our text messaging program is voluntary.

For marketing texts subject to the TCPA, the FCC requires prior express written consent and requires that consumers be clearly told that giving consent is not a condition of purchase.

Message Frequency and Charges

The Foldie does not charge you for participating in the Service.

However, message and data rates imposed by your wireless carrier may apply. You are responsible for any charges associated with SMS or MMS messages under your wireless plan.

Message frequency varies based on your interactions with The Foldie, your preferences, and the types of messages you have consented to receive.

Please contact your wireless carrier if you have questions regarding your messaging or data plan.

How to Opt Out

You may opt out of The Foldie’s mobile messaging program at any time by replying STOP to a text message from us.

Where available, you may also use an unsubscribe link contained in a text message.

After submitting a valid opt-out request, you may receive one final text message confirming that your unsubscribe request has been processed. After that confirmation, no further marketing messages will be sent to that mobile number unless you subsequently provide consent again.

The FCC permits a one-time confirmation text following an opt-out request.

If you are subscribed to more than one separate The Foldie messaging program, you may need to unsubscribe from each program separately unless applicable law requires otherwise.

Help and Customer Support

For assistance with the Service, reply HELP to a text message from The Foldie or contact us at:

support@the-foldie.com

You may also contact us through our website at The Foldie.

Changes to Our Sending Number

We may change the telephone number or short code used to operate the Service.

Where appropriate, we will notify subscribers of such changes. Messages sent to a telephone number or short code that is no longer operated by us may not be received.

Wireless Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

You agree to provide The Foldie with a valid mobile telephone number. If your mobile number changes, you should unsubscribe from the Service using your previous number where possible and subscribe again using your new number.

To the maximum extent permitted by applicable law, The Foldie, its service providers, and participating wireless carriers will not be liable for failed, delayed, or misdirected delivery of messages, errors contained in messages, or actions taken or not taken in reliance on information delivered through the Service.

Privacy

We respect your privacy.

Information collected through our mobile messaging program is handled in accordance with our Privacy Policy.

The Foldie Privacy Policy

Our current Privacy Policy already contains SMS consent language covering automated marketing messages, message frequency, opt-outs, HELP, and the fact that consent is not a condition of purchase.

Other Terms

Your participation in the Service is also subject to The Foldie’s general Terms of Service.
